These Terms of Service (“Terms”) govern your access to and use of basicnotary.com and our related services (the “Services”), operated by Basic Notary (“Basic Notary,” “we,” “us”). By creating an account or using the Services, you agree to these Terms.
The Basic Notary marketplace
Basic Notary operates an online platform that connects individuals and businesses (“Clients”) with independent notaries public (“Notaries”) for in-person, mobile, and remote online notarization (RON). Basic Notary is a technology platform, not a notary public, law firm, or attorney, and does not perform notarial acts. Notaries are independent and are solely responsible for the notarial acts they perform and for their compliance with the laws of their jurisdiction.
No legal advice
Basic Notary and the Notaries on the platform do not provide legal advice and may not act as your attorney. A notary public is not authorized to prepare legal documents, give legal advice, or represent that they can secure a particular legal outcome unless they are separately licensed to do so. In particular, the term “notario” or “notario público” in some countries refers to an attorney; in the United States a notary public is not an attorney and cannot provide legal services. If you need legal advice, consult a licensed attorney.
What notarization does
A notarization certifies the identity of a signer and the act of signing; it does not certify the legal sufficiency, accuracy, or effect of a document. You are responsible for ensuring a document is appropriate and complete for your purposes.
Eligibility & accounts
You must be at least 18 years old to use the Services. You agree to provide accurate information, keep your credentials secure, and are responsible for activity under your account. Notaries are responsible for maintaining a valid commission and any required insurance or bonding.
Remote online notarization (RON)
RON is available where permitted by applicable law and is performed by the Notary using an approved RON platform. Availability, recording, and identity-verification requirements vary by jurisdiction and are determined by applicable law and the Notary’s commission.
Fees & payments
Fees for notarial services are set as described on the Services and are processed through our third-party payment processor. You authorize the applicable charges for services you request. Statutory notarial fee limits, where they apply, are governed by the law of the Notary’s jurisdiction.
Acceptable use
You agree not to use the Services for any unlawful purpose, to request notarization of fraudulent documents, to misrepresent your identity, or to interfere with the operation or security of the Services.
Cancellations
Appointments may be cancelled or rescheduled as described on the Services. A Notary may decline or stop a notarization if legal requirements are not met (for example, if a signer cannot be properly identified or does not appear to understand or willingly sign).
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that a Notary will be available for any particular request.
Limitation of liability
To the fullest extent permitted by law, Basic Notary will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for the acts or omissions of independent Notaries or Clients. Our total liability for any claim relating to the Services will not exceed the amount you paid to Basic Notary for the transaction giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Basic Notary from claims arising out of your use of the Services or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Notarial acts are additionally governed by the law of the jurisdiction in which the Notary is commissioned.
Changes
We may update these Terms from time to time. Material changes will be posted on this page with a new effective date; your continued use of the Services constitutes acceptance.
